According to the U.S. Code of Federal Regulations (the Shipping Act of 1984), "Ocean Transportation Intermediaries to be licensed and bonded. Accepting cargo from unlicensed OTI constitutes a violation of the Shipping Act. Knowing and willful violations of the Shipping Act carry a possible civil penalty of up to $30,000 per occurrence."

According to the Act, "a U.S. Freight Forwarder (OFF) is an Ocean Transportation Intermediary (OTI). Ocean freight forwarders also prepare and process the documentation and perform related activities pertaining to those shipments."

• Foreign-based licensed NVOCC: A foreign-based NVOCC that elects to obtain a license must establish a presence in the United States by opening an unincorporated office that is resident in the United States and is qualified to do business where it is located. Refer to 46 CFR § 515.11(e)
• Registration of foreign-based unlicensed NVOCC: Any NVOCC whose primary place of business is located outside the United States and does not elect to become licensed by the Commission shall register with the Commission. Refer to 46 CFR § 515.19(a).
